This Privacy Policy describes how Skarvo, Inc. (“Skarvo”, “we”, “us” or “our”) handles personal information that we collect through our websites and mobile mobile applications that link to it (collectively, the “Service”), as well as through our marketing and other activities described in this Privacy Policy. This Privacy Policy also describes your choices with respect to personal information we collect about you.

Personal information we collect

The personal information we collect from you, either directly or indirectly, will depend on how you interact with us and with our Service. In general, we collect personal information about you from the following sources:

Information you provide to us. Personal information you may provide to us includes:

  • Contact data. Your full name, email address, phone number or other contact details.
  • Account data. Your full name, email address, phone number, password, profile photo/avatar/emoji, date of birth, notification preferences, and any other information you choose to add to your account profile.
  • User content. Content you choose to upload or post to the Service or share with other Service users, iIncluding:
    • messages, photos, images, videos, audio, text and links;
    • content you create with the Service’s features (e.g., image generator);
    • “likes” and comments on other users’ posts;
    • calendars, real-time locations, planning lists, maps, expense/receipt information, polling responses, events, notes/documents, and cards/letters/memories shared among user groups; and
    • bookmarks and Service channel subscriptions.
  • Channel content. Information that creators and brands submit when creating a channel on the Service, including the channel’s name, summary, branding elements, category and other channel-related information as well as content featured in the channel.
  • Transaction data. Any payment card data or banking details you chose to use to pay for the Service, in-app purchases made, and information about your transactions with us.
  • Identity verification data for creators and brands that choose to partner with us, including government issued identification documents (and information they contain), such as a driver’s license, and user-submitted selfie photos.
  • Communications data. Information in your communications with us, including when you communicate with us through the Service, email, chat, social media, events, or otherwise. This includes both the content of these communications and the contact details and metadata associated with it, such as social media handles and profile photos associated with your social or email accounts.
  • Referral data. Contact details of others that users provide to facilitate inviting them to use the Service. This includes contacts entered manually or in contacts to which users grant the Service access through their device permissions.  You should not share your or anyone else’s contacts or other information with us unless you have permission to do so.

If we collect personal information not specifically listed above, we will use it consistent with this Privacy Policy or as otherwise explained at the time of collection.

Automatic collection. As you navigate the Service, our communications, and other online services, we, our service providers and advertising partners may automatically collect identifiable information about you, your computer or device, and your Service usage, such as:

  • Device data. Technical information about your computer or mobile device you use to access the Service, including your device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), unique device identification numbers or other identifiers, language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), IP address, general location information associated with IP address (such as city, state, or geographic area), precise geolocation of your device when you grant access to it in your device's settings, and photos/videos/audio collected through your device’s files, camera and microphone when you grant access to them in your device’s settings.
  • Usage data. Page and screen views, authentication details, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, the videos you have watched in the Service and how long you watched them, access times and duration of access, whether you have opened our emails or clicked links within them, and other functional information on Service performance (like diagnostics and crash logs).

How we use your personal information

We use your personal information for the following purposes or as otherwise described in this Privacy Policy or at the time of collection:

  • Service delivery. We use your personal information to administer your Service account, provide the Service, process your payments, and communicate with you about our Service.
  • Business operations. We use your personal information to administer and maintain our Service and our IT systems (including monitoring, troubleshooting, data analysis, testing, system maintenance, repair, and support, reporting and hosting of data) and to operate our business.
  • Research and development. We use your personal information for research and development purposes, including to analyze and improve the Service and our business in an informed way. As part of these activities, we may create aggregated, de-identified and/or anonymized data from personal information we collect. We make personal information into de-identified or anonymized data by removing information that makes the data personally identifiable to you. We may use this aggregated, de-identified or otherwise anonymized data and share it with third parties for our lawful business purposes, including to analyze, improve and promote the Service and our business.
  • Marketing
    • Direct marketing. We may contact you about our products and services via email and other channels as permitted by law. You may opt-out of our direct marketing communications as described in the Opt-out of marketing section below.
    • Targeted advertising. Third party advertising partners that we work with use the technologies described in our Web Technologies Notice to collect personal information about your interaction with the Service (including the device data and usage data described above), our communications, and other online services over time and with different browsers and devices. They use that information to serve online ads that they think will interest you on other online services and to measure their effectiveness.  We may also share individuals’ contact data with our advertising partners (e.g., social media platforms) to facilitate interest-based advertising on their platforms to those individuals or others with similar traits.
  • Compliance and protection. We use your personal information to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities. We also use your personal information to protect our, your or others’ rights, privacy, safety, or property, including by making and defending legal claims; conducting internal audits; enforcing the terms and conditions that govern the Service; and taking steps to prevent, investigate and deter fraud, cyberattacks or other unauthorized, unethical, or illegal activity.

How we share your personal information

We may share your personal information with the following categories of recipients and as otherwise described in this Privacy Policy or at the time of collection.

  • Service providers. We share personal information with third parties that use it to provide services on our behalf or help us operate the Service or our business, such as business applications, cloud hosting and infrastructure, content delivery network, Google’s and Apple’s app store/platform services, information technology and software, customer support, customer relationship management, subscription management, telecommunications, online mapping services, email delivery, marketing, advertising, payment processing, customer research, generative artificial intelligence, and analytics.
  • Other group members. Other Service users in groups you join, with whom we share your account data, content and other personal information according to your settings.
  • Affiliates. We share personal information with our corporate affiliates for purposes consistent with this Privacy Policy.
  • Payment processors. Third party payment processors that collect your payment card data and other transaction data to process your payment card or in-app transactions when you pay for the Service. For example, Stripe processes our payment card transactions and Apple and Google process our in-app purchases.   • Identity verification services. Third party identity verification services, such as Stripe, collect the identity verification data described above. You can learn about how Stripe handles your personal information in its privacy policy available here: https://stripe.com/privacy.
  • CAPTCHA providers. To enhance the Service’s security, we use captcha features that require users to complete a task to authenticate to the Service. Third party providers of these CAPTCHA services collect device data and usage data, as described above to enable the CAPTHCA features and as described in their privacy policies. For example, we use the Google reCAPTCHA service. Your use of the Google reCAPTCHA feature is subject to its Terms of Use and Privacy Policy.
  • Advertising partners. Third party advertising companies may collect, and we may share with them, personal information for targeted advertising purposes as described above. Their use of personal information is subject to their own privacy policies.
  • Authorities and others. We may share personal information with law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
  • Professional advisors. We may share personal information with professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.
  • Business transferees. We may share personal information with parties (and their advisors) to transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, Skarvo or our affiliates (including, in connection with a bankruptcy or similar proceedings).

Your choices

Your choices regarding the personal information we hold about you include the following:

  • Access or update your information. You may review and update certain Service account information within your account settings.
  • Opt-out of marketing communications. You may opt-out of marketing emails by following the opt-out or unsubscribe instructions at the bottom of the email. Please note that if you opt-out of promotional emails, you may continue to receive service-related and other non-marketing emails. You may also contact us to ask to opt-out of marketing through other channels.
  • Request account deletion. You may request deletion of your Service account and associated information by contacting us with your request.
  • Cookies. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings.
  • Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We currently do not respond to “Do Not Track” signals. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com.
  • Targeted ads. You may use the following industry opt-out tools to opt-out of targeted ads but we cannot be certain the advertising companies we work with participate in these programs:  
  • Mobile settings. You can use your mobile device settings to limit use of the advertising ID associated with your mobile device for targeted marketing purposes.

Other sites and services

The Service may contain links to or integrations of websites and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites or other online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites and online services you use.

Security and Data Minimization

We use technical and organizational safeguards designed to protect the personal information we collect and process about you. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.

International data transfers

We are headquartered in the United States and we and our service providers may process personal information from the United States and other countries. These countries may have data protection laws that are not as protective as those where you live.

Children

The Services are not directed to children under 13 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a child of any age without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.  In addition, we may also limit how we handle personal information of Service users under 18 and may be unable to provide certain functionality to them.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service or other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Service after the effective date of any modified Privacy Policy indicates your acknowledgment that the modified Privacy Policy applies to your use of the Service and interaction with our business.

The information provided in this notice applies only to individuals in the United Kingdom (“UK”), the European Economic Area (“EEA”) and Switzerland (we collectively refer to these countries as “Europe”).

For purposes of this Notice, “personal information” has the same meaning as “personal data” under data protection laws in Europe. The personal information that we collect from you is identified and described in greater detail in the above section of the Privacy Policy entitled Personal information we collect.

Legal bases for processing. European data protection law requires that we have a “legal basis” for each purpose for which we process your personal information. Depending on the purpose for collecting your information, we may rely on one of the following legal bases:

Retention. We retain personal information for as long as necessary to fulfill the purposes for which we collected it. This includes satisfying any legal, accounting, or reporting requirements, establishing or defending legal claims, or for the compliance and protection purposes described above. Factors determining the appropriate retention period include the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the information, whether we can achieve those purposes through other means, and the applicable legal requirements.

When we no longer require the personal information we have collected about you, we will either delete or anonymize it, or if this is not possible (e.g., because it has been stored in backup archives), then we will isolate it from any further processing with security safeguards designed to protect it, until deletion is possible.

Use for new purposes. We may use your personal information for reasons not described in this Privacy Policy where permitted by law and the reason is compatible with the purpose for which we collected it. If we need to use your personal information for an unrelated purpose, we will notify you and explain the applicable legal basis.

Sensitive personal information. We do not require sensitive personal information in connection with the Service (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) and ask that you do not provide us with any such information.

Your rights. European data protection laws give individuals in Europe the following rights regarding their personal information:

  • Right of access. You can ask us to provide you with information about our processing of your personal information and give you access to your personal information.
  • Right to rectification. If the personal information we hold about you is inaccurate or incomplete, you are entitled to request to have it rectified.

  • Right to object. You can object to our processing of your personal information where we are relying on a legitimate interest (or those of a third party) and you believe it impacts your fundamental rights and freedoms. You also have the right to object where we are processing your personal information for direct marketing purposes.
  • Right to data portability. You have the right, in certain circumstances, to ask us to provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format.
  • Right to withdraw consent at any time. Where we are relying on consent to process your personal information you have the right to withdraw your consent at any time. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.

Exercising those rights. Some of these rights may be limited where we have an overriding interest or legal obligation to continue to process the personal information or where certain exemptions apply. If we decline your request, we will tell you why, subject to legal restrictions.

Your right to lodge a complaint with your supervisory authority. If you are not satisfied with our response to a request you make, or how we process your personal information, you can make a complaint to the data protection regulator in your habitual place of residence.

International data transfers. We may transfer your personal information to recipients in a country outside of Europe that is not recognized as providing an adequate level of protection for personal information by the relevant government body. In these cases, we take appropriate safeguards to ensure your personal information remains protected in accordance with this Privacy Policy and applicable laws by entering into appropriate data transfer mechanism permitted under Article 46 of the GDPR / UK GDPR (as applicable), such as the European Commission’s Standard Contractual Clauses or the UK International Data Transfer Addendum (as applicable). Web Technologies Notice

Effective as of May 6, 2025  

Skarvo, Inc. ("Skarvo," "we", "us" or "our"), our service providers, and advertising partners use the following technologies (“web technologies”) to automatically collect information through our websites and mobile applications (collectively, the “Service”) and in connection with our marketing activities:

  • Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of tracking user activity and patterns, helping the visitor navigate between pages efficiently, remembering preferences, improving the visitor’s browsing experience, and enabling functionality, analytics, and targeted advertising. Cookies used on our site include cookies that we serve as well as cookies served by third parties that we work with to enable the services they provide, such as analytics services that track traffic and usage.   • Pixels, also known as web beacons or clear GIFs, which are embedded in software code or invisibly in image files within webpages or HTML formatted emails and used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns. We may use pixels to collect information about your interactions with our email messages, such as the links you click on and whether you open or forward a message, the date and time of these interactions and the device you use to read emails.
  • Software development kits, or SDKs, which are used to incorporate third-party computer code into our Service that allows our third-party service providers or advertising partners to collect data directly from it for a variety of purposes, including to provide us with analytics regarding the use of the Service and enable certain Service functionality.

They use this information to facilitate targeted marketing campaigns and measure their performance.
